Article 84 of Saudi Labor Law:
Calculation Method:
- First 5 years: Half month salary per year
- After 5 years: One full month salary per additional year
For Resignation:
- Less than 2 years: No entitlement
- 2 to 5 years: One-third of gratuity (33.33%)
- 5 to 10 years: Two-thirds of gratuity (66.67%)
- 10 years or more: Full gratuity (100%)
For Employer Termination:
- Employee entitled to full gratuity regardless of service duration
- Unless termination is for a legitimate disciplinary reason
Important Notes:
- Last salary includes: Basic salary + Fixed allowances
- Variable allowances (commissions, bonuses) are not included
- For retirement, employee entitled to full gratuity
- Gratuity calculated proportionally for months and days
